Exclusion of the right of withdrawal according to § 312g para. 2 no. 2 BGB

There is no right of withdrawal for goods that can spoil quickly or whose expiration date would be quickly exceeded. Living beneficial insects and plants are among these sensitive products.

Beneficial insects such as parasitic wasps, nematodes, lacewings, or predatory mites must be used immediately upon delivery and can neither be returned nor reused. Plants are also sensitive to transport, temperature, and care conditions and cannot be returned to a salable condition after delivery.

Therefore, withdrawal is excluded for beneficial insects and living plants.

Canceling an order

Orders are generally processed immediately after receipt, so cancellation or modification of an order is rarely possible. If something still needs to be changed or canceled, we ask you to send an email to info@greenguardia.de as quickly as possible. If our colleagues can process the request in time, we will of course be happy to cancel or change the order. However, as soon as the order has already been processed or shipped, we can unfortunately no longer make any changes or cancellations.

Right of withdrawal

Consumers have a fourteen-day right of withdrawal.

For orders that do not contain beneficial insects or plants, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

The costs of return shipping are borne by the buyer.

To exercise your right of withdrawal, you must inform us (GREEN GUARDIA, Triftstr. 37-38, 13509 Berlin, Germany, info@greenguardia.de) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in any case, you will not be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only need to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties, and functionality of the goods.

The right of withdrawal does not exist for the following contracts:

  • Contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.

  • Contracts for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded.
    This includes in particular living beneficial insects and plants, as they are sensitive, have a limited shelf life, and cannot be returned to a salable condition after delivery.
